Abstract

Government Contracts in Egypt are governed by a number of constitutional texts and various laws in Egypt. This study aims at untangling the various legislations and assessing whether they are able to both encourage investment and secure the public good. On the other hand, there seems to be a conflict between Arbitration and the jurisdiction of the Egyptian State's Council in disputes related to government contracts. This research also tries to consolidate between opinions favoring upholding Arbitration awards in order to respect the expectations of foreign investors and those defending the interventionist decisions by the Egyptian States Council in order to secure more accountability for government officials.
