Fair and equitable treatment in BIT’s: an application on Kuwaiti-Saudi neutral zone treaties and its appendix

Abstract

One of the most important sources of international investment law is bilateral investment treaties(BIT's) . The Kuwaiti-Saudi Neutral zone treaty is considered one of oldest BIT's concerning shared natural resources either existing at the present or shall appear in the future. And for this investment treaty to be safeguarded, some standards have been established for its protection, one of the standards is fair and equitable treatment. This paper will be focused on defining this standard and analyzing the application of the standard of fair and equitable treatment on the Kuwaiti-Saudi neutral zone whole treaties (1965 and 2000) and its appendix (2020).
