Abstract

The information and communications technology at a distance, has modified the conditions and conditions of work, as it has not become necessary for the physical presence of the worker or his supervisor in the place of original work, and the latter can supervise the worker while performing his work remotely using these modern means. One of the results of the interaction between technology and legal science was the emergence of the so-called remote work contract, which dominates the electronic nature of the process of its conclusion and implementation in most of its cases, which may raise with him some challenges to legal rules, especially those related to determining how to negotiate and conclude it, The issues related to its convening, the most important of which are the time and place of the meeting, as well as the applicable law, and the most likely consequences of this contract creating many obligations and rights that affect the fulfillment of the facility on the productivity of the enterprise and the size of its investments and the development of that, which must be addressed as a subject for research. The importance of this research is embodied in the treatment of one of the products of the information revolution, which cast a shadow on the work environment; it has led to the creation of growing opportunities for conducting human transactions remotely; as the rates of exchange of communications and data between different peoples of the world increased after the emergence of the Internet, and without adherence to the geographical borders of targeted countries To increase its treatment and expansion of its investments, which is the environment in which the telework contract was born, the subject of this research in one of its most important aspects.
