Abstract

The traditional dealing with the problem of balance between encouraging investment and preserving the environment has produced unsatisfactory results, both for environmentalists and for freedom of investment advocates. This conflict of interest is due to the lack of direct linking between them in one legal organization, taking into account both interests at the same time, through legal rules characterized by binding force Since the measure of justice in everything is balanced, the ambition of this research is to achieve a balance between these conflicting interests By resorting to comparative law, and specifically to French law, we find that the legislator has tended to develop the rules of civil law in order to enhance its ability to achieve this balance.
