Abstract

The protection of the environment lies in the middle of a difficult equation between the requirements for achieving the economic renaissance, on the one hand, and the protection of economic interests driven by investment in all its forms. On the other hand, achieving sustainable development that aims to preserve the environment today and for future generations, However, international experience has shown that the environment is often sacrificed at the expense of achieving rapid and inexpensive economic growth, even if pollution and environmental degradation are one of its outcomes . In this regard, criminal discourse emerges as one of the mechanisms that allows to reduce environmental degradation as a result of industrial investments. However, criminal protection of the environment faces a number of difficulties and challenges that limit its effectiveness, which requires facing a number of shortcomings and problems in order for this protection to play its role in achieving a sustainable investment climate.
