Settlement of Arab investment disputes A study in the rules of the Arab Investment Court

Abstract

The Arab Investment Court of the Arab Standard Agreement for the Investment of Arab Capitals in the Arab Countries of 1980 is considered one of the permanent judicial mechanisms for settling investment disputes that may arise among the Arab states parties to the agreement, or between one of those countries and Arab investors or arising among the Arabs investors. The Arab agreement is considered a means to enable the Arab investor to resort to the Arab Investment Court without the prior approval of the defendant party to the dispute. The judgments issued in this regard are final and binding for implementation, as are the national judicial rulings of any Arab country. No one can deny the importance of the role the court will play in settling Arab investment disputes, but this raises a number of questions about the law to be applied before it, as well as the procedures for settlement before it, as well as the implementation of the rulings issued by it, which we will answer in our research. On this basis, we divide this research into three sections: The first section: The emergence of the Arab Investment Court. The second section: The procedures before the Arab Investment Court. The third section: The law to be applied before the Arab Investment Court.
