Sanctions against foreign investors in investment related legislation A comparative study on Kuwaiti and Palestinian legislation

Abstract

The legislation in force in both Kuwait and Palestine organized foreign investment, and it provided the investor with many advantages that encourage foreign investment, because of its positive impact on economic development in the country. In the same context, the Kuwaiti legislator issued Law No. (116) for the year 2013, which relates to investment. Legislation bearing the number (1) of 1998 was issued in Palestine to encourage investment and its amendments, and it is noted that these legislations stipulated penalties in the event that a foreign investor violates the laws regulating a state of investment, whether in Kuwait or Palestine. This study revolves around the penalties applied to foreign investors in case they violate the conditions of investment contained in the legislation related to investment in both Kuwait and Palestine, and are they deterrent and appropriate penalties for some violations and crimes, or are they sanctions that affect levels of economic development, and this is what the researcher will try to talk about During this study.
